BRIT INTELLECTUAL PROPERTY & COPYRIGHT POLICY

Intellectual Property & Copyright Policy

Effective Date: 22 September 2026
Last Updated: 22 September 2026

This Intellectual Property & Copyright Policy (“IP Policy”) explains the ownership, permitted use, licensing, protection and enforcement of intellectual property associated with BrandRipple InfoTech (“BRIT”, “BrandRipple InfoTech”, “we”, “us”, “our”, or “the Company”), including materials available through https://brandrippleinfotech.com/ (the “Website”), our professional Services, Digital Products, creative work, downloadable resources and related digital assets.

This Policy applies to intellectual property created, owned, licensed, commissioned, supplied, displayed, distributed or otherwise used by BRIT, subject to applicable law and any specific agreement governing a particular project or Product.

This Policy should be read together with our:

  • Terms & Conditions;
  • Privacy Policy;
  • Refund, Cancellation & Digital Product Delivery Policy;
  • Digital Product License & Usage Policy;
  • Cookie Policy;
  • Website Disclaimer; and
  • applicable Project Agreements, proposals, quotations, invoices, Product licences and other written contractual terms.

By accessing, browsing, downloading, purchasing, copying, displaying, modifying or otherwise using BRIT’s intellectual property or Website content, you acknowledge and agree to this Policy to the extent permitted by applicable law.

1. Purpose of This Policy

The purpose of this Policy is to establish clear rules concerning:

  • ownership of BRIT intellectual property;
  • Website content;
  • copyright;
  • trademarks;
  • branding assets;
  • Digital Products;
  • client materials;
  • commissioned work;
  • third-party content;
  • AI-assisted content;
  • permitted use;
  • prohibited use;
  • infringement reporting; and
  • enforcement of intellectual-property rights.

2. What Is Intellectual Property?

Intellectual property may include, among other things:

  • copyrights;
  • trademarks;
  • service marks;
  • logos;
  • brand names;
  • domain-related rights;
  • design rights;
  • trade dress;
  • graphics;
  • illustrations;
  • photographs;
  • videos;
  • written content;
  • website content;
  • software;
  • source code;
  • templates;
  • digital resources;
  • documents;
  • databases;
  • methodologies;
  • concepts;
  • processes;
  • frameworks;
  • know-how; and
  • other proprietary materials.

Different intellectual-property rights may be owned by BRIT, a client, a third party or another rights holder depending on the particular material.

3. BRIT’s Ownership of Website Content

Unless expressly stated otherwise, BRIT owns or has the lawful right to use the intellectual property appearing on the Website.

This may include:

  • Website text;
  • page layouts;
  • visual designs;
  • graphics;
  • illustrations;
  • photographs;
  • videos;
  • animations;
  • icons;
  • logos;
  • branding elements;
  • downloadable resources;
  • presentations;
  • documents;
  • product descriptions;
  • original creative concepts;
  • software elements;
  • page structures; and
  • other original Website materials.

4. Copyright Protection

Original literary, artistic, graphic, audiovisual, software and other qualifying works made available by BRIT may be protected by copyright under applicable law.

The Copyright Act, 1957 provides the principal statutory framework for copyright protection in India and provides remedies for copyright infringement.

Copyright ownership and permitted use depend on the nature of the work, applicable law, contractual arrangements and any third-party rights.

5. No Automatic Right to Copy

Accessing the BRIT Website does not automatically grant a user the right to:

  • copy;
  • reproduce;
  • publish;
  • redistribute;
  • sell;
  • license;
  • modify;
  • repurpose; or
  • commercially exploit

BRIT’s copyrighted materials.

Any use beyond what is expressly permitted by law or by BRIT’s written authorization requires appropriate permission.

6. Limited Personal Website Use

Subject to these Terms and applicable law, users may generally view Website content for ordinary personal or business reference purposes.

This limited access does not transfer ownership or create a license to commercially exploit BRIT’s intellectual property.

7. Commercial Use of Website Content

Unless expressly authorized in writing, users must not use BRIT’s Website content for commercial exploitation.

This includes:

  • republishing Website articles for commercial gain;
  • copying Website graphics into another commercial Website;
  • selling BRIT-created resources;
  • incorporating BRIT’s original content into competing products;
  • creating derivative commercial materials from substantial Website content; or
  • using BRIT’s proprietary resources as a substitute for purchasing or licensing them.

8. BRIT Trademarks and Brand Identity

The names, logos, visual identity, marks, taglines, brand assets and other identifiers associated with BrandRipple InfoTech may constitute trademarks, service marks, branding assets or other protected intellectual property.

The Trade Marks Act, 1999 provides the statutory framework for registered trademark rights in India, including rights against infringement of registered marks.

No right to use BRIT’s trademarks is granted merely by accessing the Website.

9. Unauthorized Use of BRIT Branding

Unless expressly authorized, users must not:

  • reproduce BRIT’s logo for commercial purposes;
  • use BRIT branding as their own;
  • create confusingly similar branding;
  • register BRIT branding as a trademark or domain;
  • use BRIT’s identity to imply affiliation or endorsement;
  • use BRIT’s logo in advertisements implying sponsorship; or
  • create a misleading association with BrandRipple InfoTech.

10. BRIT Domain and Digital Identity

The BRIT domain name and associated digital identities are part of the Company’s broader digital and brand assets.

Unauthorized use of confusingly similar domains, social handles, digital identities or online branding may be subject to appropriate action where legally available.

11. Digital Products

BRIT may create and sell Digital Products including:

  • templates;
  • branding kits;
  • design resources;
  • graphics;
  • business resources;
  • marketing materials;
  • documents;
  • guides;
  • toolkits;
  • editable files;
  • creative assets;
  • AI-assisted resources;
  • downloadable bundles; and
  • other digital resources.

Digital Product ownership and customer usage rights are governed by the Digital Product License & Usage Policy and any Product-specific license terms.

12. Purchase of a Digital Product Does Not Transfer Copyright

Unless expressly stated otherwise in writing, purchasing a Digital Product does not transfer the underlying copyright or other intellectual-property ownership to the purchaser.

The purchaser receives only the rights expressly granted by the applicable license.

Possession of a downloadable file does not by itself establish ownership of its underlying intellectual property.

13. Digital Product License

The purchaser’s permitted use of a Digital Product is determined by:

  • the Product page;
  • the applicable Product-specific license;
  • the Digital Product License & Usage Policy;
  • the Terms & Conditions; and
  • applicable law.

Where those documents expressly limit usage, the purchaser must comply with those limitations.

14. Prohibited Copying of Digital Products

Unless expressly authorized, users must not:

  • reproduce the original Product;
  • make unauthorized copies;
  • upload source files;
  • distribute files;
  • share download links;
  • resell the Product;
  • sublicense the Product;
  • include the Product in another downloadable bundle;
  • provide the Product to unauthorized users; or
  • otherwise commercially exploit the Product outside its permitted license.

15. Modification Does Not Transfer Ownership

Where editing of a Digital Product is permitted, modifying the Product does not automatically transfer ownership of the original intellectual property.

A modified copy remains subject to the applicable license.

Changing:

  • colors;
  • fonts;
  • wording;
  • layouts;
  • dimensions;
  • file format;
  • images; or
  • other design elements

does not automatically create an independent right to resell or redistribute the original underlying Product.

16. Finished Work Created Using BRIT Products

Where an applicable license permits commercial use, a customer may use a Digital Product to create a permitted final or finished work.

For example, a licensed template may be used to create:

  • promotional graphics;
  • presentations;
  • marketing materials;
  • social-media content;
  • client-facing documents; or
  • other permitted outputs.

The final-use rights do not automatically include the right to redistribute the underlying BRIT source Product.

17. Client Work and Commissioned Projects

When BRIT provides custom branding, design, website, technology, content or other professional Services, ownership of project deliverables will be governed by the applicable Project Agreement.

The fact that a client has paid for Services does not automatically mean that every underlying tool, process, template, working file, source file or reusable component becomes the client’s property.

18. Pre-Existing BRIT Materials

BRIT retains ownership of materials, tools, frameworks and intellectual property that existed before or were independently developed outside a particular client engagement.

This may include:

  • templates;
  • frameworks;
  • design systems;
  • libraries;
  • reusable components;
  • internal tools;
  • methodologies;
  • workflows;
  • processes;
  • code libraries;
  • prompts;
  • know-how; and
  • other reusable assets.

19. Client-Supplied Materials

A client retains ownership of materials that the client lawfully owns or controls and supplies to BRIT for a project.

These may include:

  • logos;
  • trademarks;
  • photographs;
  • product information;
  • written content;
  • brand assets;
  • videos;
  • documents;
  • illustrations; and
  • other client-provided materials.

The client grants BRIT permission to use those materials as reasonably necessary to provide the agreed Services.

20. Client Warranty Regarding Submitted Materials

The client represents that it has the necessary rights, permissions and authority to provide materials to BRIT for the agreed purpose.

The client remains responsible for claims arising from unauthorized use of materials supplied by the client.

21. Source Files

Source files may include:

  • editable design files;
  • working documents;
  • layered graphics;
  • source code;
  • project files;
  • design systems;
  • internal templates; and
  • other production materials.

Whether source files are included in a project delivery will depend on the applicable Project Agreement.

Payment for a Service does not automatically include every working or source file unless expressly stated.

22. Transfer of Rights in Final Deliverables

Where a Project Agreement expressly provides for transfer of specified intellectual-property rights in final deliverables, the transfer will occur according to the conditions stated in that agreement.

Unless otherwise stated, BRIT may condition such transfer upon full payment of the applicable agreed fees.

23. Rights in Unused Concepts

Unless otherwise agreed, concepts, drafts, unused directions, rejected proposals and alternative creative explorations remain the property of BRIT where they are not transferred under the applicable Project Agreement.

A client receiving one final selected concept does not automatically obtain rights to all unused concepts.

24. Rights in Design Process Materials

BRIT may retain ownership of internal:

  • sketches;
  • research;
  • drafts;
  • ideation;
  • moodboards;
  • working documents;
  • process materials;
  • preliminary concepts; and
  • rejected directions,

unless the relevant Project Agreement expressly provides otherwise.

25. Third-Party Intellectual Property

The Website, Services and Digital Products may include third-party intellectual property.

Examples may include:

  • stock photography;
  • licensed fonts;
  • icons;
  • illustrations;
  • software;
  • plugins;
  • APIs;
  • music;
  • video;
  • datasets;
  • AI technologies;
  • third-party templates; and
  • other licensed materials.

Third-party rights remain with their respective owners.

26. No Transfer of Third-Party Rights

BRIT cannot grant rights that it does not itself own or have authority to grant.

A client or purchaser may therefore be required to comply with separate third-party licenses.

The purchase of a BRIT Product does not automatically provide unrestricted rights to every third-party component incorporated into it.

27. Fonts and Licensed Assets

Where a Product or project incorporates a font or other licensed asset, the applicable third-party license may govern:

  • number of users;
  • number of devices;
  • commercial use;
  • web use;
  • app use;
  • redistribution; or
  • other usage.

The customer is responsible for obtaining any separate license required for its intended use where such responsibility applies.

28. Stock Images and Media

Where BRIT uses licensed stock imagery or media, the applicable rights may be limited by the licensing provider.

Unless expressly stated, customers should not assume that an underlying stock photograph or media asset has been transferred to them.

29. Software and Open-Source Components

Where applicable, Website or project technology may include open-source or other third-party software.

Such components may be subject to separate license terms.

BRIT’s own rights in custom-developed material remain distinct from the rights governing third-party software.

30. AI-Assisted Intellectual Property

BRIT may use Artificial Intelligence (“AI”), generative AI and AI-assisted tools in the creation or development of certain:

  • graphics;
  • text;
  • concepts;
  • workflows;
  • templates;
  • illustrations;
  • research;
  • digital resources; or
  • other materials.

AI-assisted output may be subject to third-party platform terms and may not receive identical intellectual-property protection for every component.

Accordingly, BRIT does not automatically represent that every AI-assisted element is exclusively owned by BRIT or capable of exclusive legal protection.

31. AI-Generated Similarity

AI systems may generate output that is similar to material independently created by another person.

Where AI-assisted methods are used, BRIT may apply reasonable human review and refinement, but this does not guarantee that every output is completely unique worldwide or free from every potential third-party claim.

32. Copyright Registration and Trademark Registration

Publication, purchase or delivery of a work does not automatically mean that the work:

  • has been registered with a government authority;
  • qualifies for registration;
  • is available for exclusive trademark registration;
  • is legally cleared for every possible use; or
  • is free from conflicting third-party rights.

Registration and clearance are separate legal processes.

33. Trademark Clearance

Where BRIT creates a proposed name, logo or identity for a client, the client remains responsible for obtaining appropriate trademark searches, legal clearance and registration unless those Services are expressly included in the agreed scope.

BRIT’s creative work does not itself constitute a legal opinion that a proposed trademark is available or registrable.

34. Copyright Notices

Where BRIT places copyright, trademark, ownership or license notices on its Website, Products or materials, users must not intentionally remove or alter those notices where they are intended to remain.

35. Linking to BRIT Website

Users may link to the public BRIT Website provided that the link:

  • is lawful;
  • is not misleading;
  • does not imply sponsorship or endorsement without permission;
  • does not frame or reproduce substantial Website content without authorization; and
  • does not damage BRIT’s reputation.

BRIT may request removal of a misleading or unauthorized link.

36. Screenshots and Social-Media Sharing

Users may share reasonable references to publicly available BRIT Website content through ordinary social-media or communication channels where such sharing is lawful and does not imply ownership or endorsement.

Users should not systematically reproduce substantial amounts of BRIT content.

37. Search Engine and Indexing Use

Search engines may index publicly accessible Website content according to their ordinary technical processes.

Such indexing does not grant third parties the right to reproduce substantial BRIT content outside the scope permitted by law.

38. No Unauthorized Data or Content Scraping

Unless expressly permitted by BRIT or applicable law, users must not systematically scrape, harvest, reproduce or extract substantial quantities of:

  • Website text;
  • Product information;
  • graphics;
  • Digital Products;
  • databases;
  • pricing information;
  • creative resources;
  • metadata; or
  • other Website materials

for commercial exploitation or to create competing services.

39. Prohibited Dataset Use

Unless expressly authorized, users must not collect or compile BRIT’s substantial Website content or Digital Products into datasets for:

  • commercial redistribution;
  • machine-learning training;
  • generative AI training;
  • model development;
  • competing databases;
  • content libraries; or
  • other large-scale computational reuse.

40. Intellectual Property in Customer Reviews

Where users voluntarily provide testimonials, reviews or other public feedback, the user retains rights that legally remain with them, while BRIT may use the submitted review for legitimate business and promotional purposes subject to the applicable agreement, notice and privacy requirements.

BRIT will not intentionally represent another person’s words as a testimonial from a different individual.

41. Portfolio Use of BRIT-Created Work

Unless restricted by a written confidentiality agreement or Project Agreement, BRIT may display completed public-facing work in its:

  • portfolio;
  • case studies;
  • website;
  • social-media channels;
  • presentations;
  • proposals; and
  • promotional materials.

This does not grant BRIT ownership of client-owned intellectual property.

42. Confidential Projects

Where a project is subject to confidentiality restrictions, BRIT will handle portfolio use according to the applicable agreement.

Clients who require complete confidentiality should communicate this before public release or establish appropriate contractual terms.

43. Copyright Infringement by Users

Unauthorized use of BRIT’s copyrighted material may constitute copyright infringement.

Depending on the circumstances, BRIT may seek remedies available under applicable law.

The Copyright Act, 1957 provides civil remedies for infringement including injunctions, damages and other relief.

44. Trademark Infringement

Where applicable, unauthorized use of BRIT’s registered trademarks or confusingly similar marks may constitute trademark infringement.

The Trade Marks Act, 1999 provides statutory rights and remedies concerning registered trademarks and infringement.

45. Unauthorized Digital Product Distribution

Unauthorized distribution of BRIT Digital Products may include:

  • public file sharing;
  • upload to marketplaces;
  • resale;
  • redistribution through private groups;
  • distribution through membership libraries;
  • sharing download links;
  • unauthorized client distribution; or
  • other unauthorized access.

BRIT may investigate and enforce its rights where appropriate.

46. Notice of Intellectual Property Infringement

If you believe that material available through the BRIT Website infringes your intellectual-property rights, you may contact BRIT through the official contact details published on the Website.

Your notice should provide sufficient information to allow BRIT to identify and evaluate the complaint.

47. Information for an Infringement Complaint

Where applicable, an intellectual-property complaint should include:

  • complainant’s full name;
  • contact details;
  • identification of the intellectual property claimed;
  • evidence or explanation of ownership or authority;
  • identification of the allegedly infringing material;
  • relevant URL or location;
  • explanation of the alleged infringement;
  • supporting documents where appropriate; and
  • a statement that the information provided is accurate to the best of the complainant’s knowledge.

48. Authorization to Act

Where a complaint is submitted on behalf of another person or organization, BRIT may require evidence that the complainant is authorized to act on the rights holder’s behalf.

49. Review of Infringement Complaints

Upon receiving a sufficiently detailed complaint, BRIT may review:

  • the relevant content;
  • ownership information;
  • licensing arrangements;
  • applicable agreements;
  • Product terms;
  • third-party rights; and
  • other relevant circumstances.

BRIT may request additional information where reasonably necessary.

50. Removal or Restriction of Content

Where BRIT reasonably determines that material should be removed, restricted or modified, BRIT may take appropriate action.

Such action may include:

  • removing Website content;
  • restricting access;
  • suspending a user account;
  • disabling a Digital Product link;
  • contacting a service provider;
  • requesting third-party removal; or
  • taking other lawful measures.

51. No Automatic Removal Upon Complaint

Submitting an infringement complaint does not automatically establish that infringement has occurred.

BRIT may review the available evidence and applicable rights before taking action.

Nothing in this Policy prevents a rights holder from pursuing remedies available under law.

52. Counterclaims or Disputed Complaints

Where a user disputes an infringement claim, BRIT may request information explaining the user’s authorization or legal basis for use.

BRIT may consider relevant evidence before determining an appropriate response.

53. Good-Faith Complaints

Intellectual-property complaints should be submitted in good faith and supported by accurate information.

Knowingly false or materially misleading complaints may have legal consequences.

54. Preservation of Rights

BRIT’s failure to immediately enforce an intellectual-property right does not constitute a waiver of that right.

BRIT reserves all rights and remedies available under applicable law.

55. No Implied License

Nothing on the Website should be interpreted as granting an implied license to use BRIT’s intellectual property beyond rights expressly granted by law or contract.

56. Fair Dealing and Statutory Exceptions

Nothing in this Policy is intended to restrict rights or exceptions that are legally available under applicable copyright or other intellectual-property law.

Any use falling within a statutory exception remains subject to the specific requirements and limitations of that law.

57. Intellectual Property Created by Contractors or Third Parties

Where BRIT engages freelancers, contractors, consultants or other third parties to create work, BRIT will seek to establish appropriate rights or permissions through contractual arrangements where commercially and legally appropriate.

The specific ownership of particular work may depend upon the applicable agreement.

58. Client-Requested Third-Party Material

If a client instructs BRIT to use particular third-party content, the client remains responsible for ensuring that the content may lawfully be used for the intended purpose unless BRIT expressly agrees to undertake that clearance as part of the engagement.

59. No Warranty of Worldwide Ownership Clearance

BRIT does not automatically guarantee worldwide ownership clearance, trademark availability, copyright exclusivity or non-infringement for every creative asset.

Where a project requires formal intellectual-property clearance, the scope should expressly include appropriate legal or professional review.

60. Intellectual Property and Digital Product Refunds

Unauthorised use, copying or redistribution of a Digital Product may constitute a breach of the applicable license and does not create an automatic refund entitlement.

Refunds remain subject to the Refund, Cancellation & Digital Product Delivery Policy and applicable law.

61. Intellectual Property and Privacy

BRIT may retain information necessary to investigate intellectual-property complaints, unauthorized downloads, account misuse or infringement allegations.

Such information will be handled in accordance with BRIT’s Privacy Policy and applicable law.

62. Intellectual Property and Security

BRIT may use technical measures to protect its Digital Products and Website content from unauthorized access or distribution.

Users must not intentionally circumvent such controls.

63. Enforcement

Where BRIT identifies or reasonably suspects unauthorized use of its intellectual property, BRIT may take one or more lawful actions, including:

  • requesting removal;
  • suspending access;
  • terminating a Product license;
  • suspending a customer account;
  • contacting hosting or platform providers;
  • issuing legal notices;
  • seeking injunctions;
  • seeking damages or other lawful remedies; and
  • pursuing other available legal rights.

The Copyright Act, 1957 provides civil remedies for infringement, while other applicable intellectual-property laws may provide additional remedies depending on the circumstances.

64. Cooperation with Legal Authorities

Where legally required or appropriate, BRIT may provide relevant records or information to:

  • courts;
  • tribunals;
  • government authorities;
  • law-enforcement agencies;
  • regulatory bodies; or
  • other competent authorities.

Any disclosure will be handled subject to applicable law and BRIT’s Privacy Policy.

65. Changes to This Intellectual Property Policy

BRIT reserves the right to modify, amend, revise, replace, update, supplement or otherwise change this Intellectual Property & Copyright Policy from time to time, subject to applicable law.

Changes may occur because of:

  • new Products;
  • new Services;
  • changes in intellectual-property practices;
  • new technologies;
  • AI-assisted workflows;
  • Website developments;
  • e-commerce developments;
  • changes in third-party licensing;
  • legal or regulatory developments; or
  • other legitimate business or legal reasons.

The latest version will be published on the Website with the applicable “Last Updated” date.

66. Acceptance of Updated Intellectual Property Policy

By continuing to access or use the Website, Products or Services after an updated version of this Policy has been published, you acknowledge the revised Policy to the extent permitted by applicable law.

This applies regardless of whether the Website is accessed through:

  • desktop;
  • laptop;
  • mobile phone;
  • tablet;
  • browser;
  • application;
  • direct URL;
  • email;
  • social media;
  • advertisement; or
  • any other current or future device or access method.

Where a particular transaction requires express acceptance of updated terms, the applicable transaction-specific mechanism will apply.

67. Relationship with the Digital Product License Policy

The Digital Product License & Usage Policy contains the detailed usage rights for purchased Digital Products.

Where a Product-specific license grants broader or narrower rights, those terms will govern that Product to the extent of the difference.

68. Relationship with Project Agreements

For custom Services, the applicable proposal, quotation, statement of work, contract or Project Agreement will determine ownership and licensing of project deliverables.

This Policy applies to matters not otherwise specifically addressed by that agreement.

69. Relationship with Terms & Conditions

This Policy forms part of BRIT’s broader Terms & Conditions and Website legal framework.

The Terms & Conditions continue to govern Website use, transactions, liability, disputes and other general contractual matters.

70. No Waiver

Failure by BRIT to enforce any intellectual-property provision immediately does not constitute a waiver of the right to enforce it later.

71. Severability

If any provision of this Policy is determined to be invalid, unlawful or unenforceable, the remaining provisions shall continue to operate to the fullest extent permitted by law.

72. Governing Law

This Policy shall be governed by the laws of India, subject to applicable mandatory statutory rights and protections.

73. Dispute Resolution

Any dispute relating to intellectual-property ownership, licensing or use should first be raised with BRIT through the official contact channel.

Where the matter cannot be resolved amicably, the dispute-resolution provisions contained in the applicable Terms & Conditions or Project Agreement shall apply, subject to applicable law.
